Introduction

Our registered users (‘Panelists’) share their profile information, take market research surveys and get rewarded (‘Services’). Content and data on some of our Services is visible to Panelists and non-Panelists (e.g. Visitors to our Services, and our Clients). As a Panelist or Visitor to our Services, the collection, use and sharing of your personal information is subject to this Privacy Policy (which includes our Cookie Policy) and updates.


Your Privacy Matters To Us

QOR respects and upholds your rights under the Australian Privacy Principles contained in the Privacy Act 1988 (Cth) ("Privacy Act"). QOR also adheres to the Privacy (Market and Social Research) Code 2014 (“Code”).

This Privacy Policy lets you know what personal information of yours we may collect, what we do with it, who we will disclose it to, and how you can access personal information we hold about you. In this policy "personal information" has the same meaning as under the Privacy Act.


  1. Data We Collect

    1.2. Data You Provide To Us

    a) Registration

    You provide data to create an account with us.

    To create an account you need to provide personal information including your name, gender, date of birth, email address, postal address, and a password.


    b) Profile

    We collect personal information from you when you provide it to our Services, such as when you fill out a form (e.g. with demographic data) or respond to a survey. You have choices about the information on your profile, such as your education, work experience, and further profile information. You don’t have to provide additional information on your profile; however, profile information helps you to get more from our Services, including more surveys and a higher chance of completing surveys. Some personal information sharing is required in order to complete surveys and earn an incentive. Please do not post or add personal information to your profile that you would not want to be available to others.


    c) Sensitive Personal Information

    You give us your personal information when you create your profile (a complete profile helps you get the most from our Services).

    Some of our surveys may require you to provide personal information that is regarded as sensitive. Your consent to provide us with your sensitive personal information will make you eligible to take additional client surveys. ‘Sensitive information’ is defined in the Privacy Act to mean information or an opinion about an individual’s:

    • racial or ethnic origin;
    • political opinions;
    • membership of a political association;
    • religious beliefs or affiliations;
    • philosophical beliefs;
    • membership of a professional or trade association;
    • membership of a trade union;
    • sexual preferences or practices; or
    • criminal record.

    ‘Sensitive information’ also includes health information and genetic information about an individual that is not otherwise health information.

    It’s your choice whether to include sensitive information on your profile. You can choose not to share certain parts of your personal information; though if you don’t, it may limit the surveys that we can make available to you. For our part, we will always seek your express consent before we collect and process personal information regarded as ‘sensitive’.


    1.3. Data From Others

    a) Partners

    Customers and partners may provide data to us.

    We receive personal information about you when you use the services of our customers and partners, such as market research agencies, consumer packaged goods companies, and others.


    b) Service Use

    We log your visits and use of our Services, including mobile apps

    We log usage data when you visit or otherwise use our Services, including our sites, app and platform technology such as when you view or click on content (e.g. polls, participate in the forum), install or update one of our mobile apps. We use log-ins, cookies, device information and internet protocol (‘IP’) addresses to identify you and log your use.

    We collect data through cookies and similar technologies.

    At QOR, we believe in being clear and open about how we collect and use data related to you. This policy provides further information about how and when we use cookies. This cookie policy applies to any QOR product or service that links to this policy or incorporates it by reference.

    A cookie is a small file placed onto your device that enables certain features and functionality. For example, cookies enable us to identify your device, secure your access to QOR site(s), and even help us know if someone attempts to access your account from a different device. Cookies also enable you to easily share content on our Services and help us serve relevant surveys to you.

    What types of cookies does QOR use?

    We use two types: persistent cookies and session cookies. A persistent cookie helps us recognize you as an existing user, so it’s easier to interact with or return to our Services without signing in again. After you sign in, a persistent cookie stays in your browser and will be read by QOR when you return to one of our sites or a partner site that uses our services. Session cookies only last for as long as the session (usually the current visit to a website or a browser session).


    What are cookies used for?

    Cookies can be used to recognize you when you visit QOR Services, remember your preferences, and give you a personalized experience that’s in line with your settings. Cookies also make your interactions with our Services faster and more secure. For example, a cookie tells the web server that you have returned to a specific page. If you personalize QORSurveys, or register with QORSurveys Site or services, a cookie helps QOR to recall your specific information on subsequent visits.     a) Your Device and Location

    We receive data from your devices and networks, including location data.

    When you visit or leave our Services (including our plugins or cookies or similar technology on the sites of others), we receive the URL of both the site you came from and the one you go to next. We also get information about your IP address, proxy server, operating system, web browser and add-ons, device identifier and features, and/or ISP or your mobile carrier. If you use our Services from a mobile device, that device will send us data about your location based on your phone settings. We will ask you to opt-in before we use GPS or other tools to identify your precise location.


    b) Sites and Services of Others

    We get data when you visit sites that include our cookies.

    We receive information about your visits and interaction with services provided by others when you visit others’ services that include our cookies or similar technologies.

    We are improving our Services, which means we get new data and create new ways to use data.

    Our Services are dynamic, and we often introduce new features, which may require the collection of new information. If we collect materially different personal information or materially change how we use your data, we will notify you and may also modify this Privacy Policy.


  2. How We Use Your Personal Information

    We use your data to provide, support, personalize and develop our Services.

    How we use your personal information will depend on which Services you use, how you use those Services and the choices you make in your settings. We use the personal information that we have about you to provide and personalize (including with the help of automated systems and inferences we make) our Services so that they can be more relevant and useful to you.


    2.2. Services

    Our Services help you earn rewards by using your time to give feedback to businesses that need it.

    We use your personal information to authorise access to our Services. Our Services allow you to provide input to businesses so they can customize their offerings, introduce new products, and otherwise influence the marketplace. In exchange, you will earn rewards for each completed survey, which can eventually be redeemed. We will use your personal information (such as your profile) to better match you to survey opportunities.


    2.3. Communications

    We contact you with regard to our Services. We offer you options to control what messages you receive and how often you receive some types of messages.

    We will contact you through email, mobile phone, notices posted on our websites or apps, messages to your inbox, and other ways through our Services, including text messages and push notifications. We will send you messages about the availability of our Services, security, or other service-related issues. We also send messages about how to use the Services, network updates, and reminders. You may change your communication preferences at any time. Please be aware that you cannot opt-out of receiving service messages from us, including security and legal notices.


    2.4. Marketing

    We use data and content about Panelists for invitations and communications promoting panelist and network growth, engagement and our Services


    2.5. Developing Services and Research

    a) Service Development

    We use personal information, including public feedback, to conduct research and development for the further development of our Services in order to provide you and others with a better, more intuitive and personalized experience, drive Panelist growth and engagement on our Services, and help connect Panelists to survey opportunities.


    b) Polls

    We develop our Services and conduct research

    Polls are conducted by us and others through our Services. Participating in polls is optional. You also have choices about the information you provide.


    2.6. Customer Support

    We use personal information to help you and fix problems.

    We use the data (which can include your communications and personal information) to investigate, respond to and resolve complaints and Service issues (e.g. bugs).


    2.7. Aggregate Insights

    We use personal information to generate aggregate insights.

    We use your personal information to produce and share aggregated insights that do not identify you. For example we may use your personal information to generate statistics about our Panelists, their profession or industry, to calculate ad impressions served or clicked on, or to publish visitor demographics for a Service or demographic workforce insights.


    2.8. Security and Investigations

    We use your personal information (including your communications) if we think it’s necessary for security purposes or to investigate possible fraud or other violations of our User Agreement or this Privacy Policy and/or attempts to harm our Panelists, Clients or Visitors.


  3. How We Share Information

    3.2. Our Services

    Your profile is fully visible to customers of our Services (i.e. our Clients). Additionally, posts on the forum are also visible to others (e.g. Visitors to our Services). Any data that you include on your profile and any content you post or social action (e.g. likes, follows, comments, shares) you take on our Services may be seen by others.


    3.3. Related Services

    We will share your personal information with our Clients to provide and develop our Services. We may combine information internally across the different Services covered by this Privacy Policy to help our Services be more relevant and useful to you and our Clients.


    3.4. Service Providers

    We use others to help us provide our Services (e.g. maintenance, analysis, audit, payments, fraud detection, marketing and development). They will have access to your personal information as reasonably necessary to perform these tasks on our behalf and are obligated not to disclose or use it for other purposes.


  4. Openness

    You have the right to request access to any personal information we hold about you. You can request this information by contacting the Privacy Officer at the details listed below. Where we hold information that you are entitled to access, we will respond to your request in a reasonable time and endeavour to provide you with a suitable range of choices as to how access is provided (eg, emailing or mailing it to you). A fee may be charged to cover the cost of retrieval. However this fee will not be excessive and will only apply to the facilitation of your request. If at any time you believe that personal information we hold about you is incorrect, incomplete or inaccurate, then you may request amendment of it and we will either amend the information or make a record of your comment, as we think appropriate.

  6. Retention And Destruction Of Personal Information

    When your personal information is destroyed/deleted

    QOR will destroy or de-identify your personal information as soon as practicable once it is longer needed for the Services. However, we may in certain circumstances be required by law to retain your personal information after Services have ceased. In this case your personal information will continue to be protected in accordance with this Policy. If we destroy personal information we will do so by taking reasonable steps and using up-to-date techniques and processes.


  7. Security Of Information

    How we protect your personal information

    QOR will take reasonable steps to protect your personally identifiable information as you transmit your information from your computer to our website and to protect such information from loss, misuse, and unauthorised access, use, modification, disclosure, alteration, or destruction. However, you should keep in mind that the transmission of information over the Internet is not completely secure or error-free. In particular, e-mail sent to or from this website may not be secure, and you should therefore take special care in deciding what information you send to us via e-mail.


  8. Miscellaneous

    This Privacy Policy is effective from 1st November 2019. We may change this policy from time to time. Although we intend to observe this Privacy Policy at all times, it is not legally binding on QOR in any way. From time to time we may regard it as necessary or desirable to act outside the policy. QOR may do so, subject only to any other applicable contractual rights you have and any statutory rights you have under the Privacy Act or other applicable legislation.


Agreement between user and QOR

The QORSurveys Site is comprised of various Web pages operated by QOR. The QORSurveys Site is offered to you conditional on your acceptance without modification of the terms, conditions, and notices contained herein. Your use of the QORSurveys Site constitutes your agreement to all such terms, conditions, and notices.


Modification of these terms of use

QOR reserves the right to change the terms, conditions, and notices under which the QORSurveys Site is offered, including but not limited to the charges associated with the use of the QORSurveys Site.


Links to third party sites

The QORSurveys Site may contain links to other Web Sites ("Linked Sites"). The Linked Sites are not under the control of QOR and QOR is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. QOR is not responsible for webcasting or any other form of transmission received from any Linked Site. QOR is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by QOR of the site or any association with its operators.


No unlawful or prohibited use

As a condition of your use of the QORSurveys Site, you warrant to QOR that you will not use the QORSurveys Site for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the QORSurveys Site in any manner which could damage, disable, overburden, or impair the QORSurveys Site or interfere with any other party's use and enjoyment of the QORSurveys Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the QORSurveys Sites.


Use of communication services

The QORSurveys Site may contain bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars, and/or other message or communication facilities designed to enable you to communicate with the public at large or with a group (collectively, "Communication Services"), you agree to use the Communication Services only to post, send and receive messages and material that are proper and related to the particular Communication Service. By way of example, and not as a limitation, you agree that when using a Communication Service, you will not:

Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others. Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information. Upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents. Upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer. Advertise or offer to sell or buy any goods or services for any business purpose, unless such Communication Service specifically allows such messages. Conduct or forward surveys, contests, pyramid schemes or chain letters. Download any file posted by another user of a Communication Service that you know, or reasonably should know, cannot be legally distributed in such manner. Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded. Restrict or inhibit any other user from using and enjoying the Communication Services. Violate any code of conduct or other guidelines which may be applicable for any particular Communication Service. Harvest or otherwise collect information about others, including e-mail addresses, without their consent. Violate any applicable laws or regulations.

QOR has no obligation to monitor the Communication Services. However, QOR reserves the right to review materials posted to a Communication Service and to remove any materials in its sole discretion. QOR reserves the right to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever.

QOR reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in QOR 's sole discretion.

Always use caution when giving out any personally identifying information about yourself or your children in any QOR. QOR does not control or endorse the content, messages or information found in any Communication Service and, therefore, QOR specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation in any Communication Service. Managers and hosts are not authorised QOR spokespersons, and their views do not necessarily reflect those of QOR. Materials uploaded to a Communication Service may be subject to posted limitations on usage, reproduction and/or dissemination. You are responsible for adhering to such limitations if you download the materials


Confidentiality of surveys

QOR 's clients may disclose confidential and/or proprietary information and materials to you as part of Surveys, and such information and materials shall remain the sole and exclusive property of its owner. This confidential information may include, but is not limited to, new product ideas or concepts, packaging concepts, advertising and movie or television concepts or trailers, and the text, visual images and sounds related thereto. By becoming a member, you agree that you will keep the contents and materials disclosed to you as part of all Surveys in which you participate confidential and not disclose them to any third party or use the confidential information for any purpose except for the sole purpose of completing the Survey. If you breach this obligation, in addition to forfeiture of your points and termination of your account, you may be liable for monetary damages to QOR and/or our client for damages caused by the result of your breach.


Materials provided to QORSurveys or posted at any QORSurveys web site

QOR does not claim ownership of the materials you provide to QOR (including feedback and suggestions) or post, upload, input or submit to any QORSurveys Site or its associated services (collectively "Submissions"). However, by posting, uploading, inputting, providing or submitting your Submission you are granting QOR, its affiliated companies and necessary sublicenses permission to use your Submission in connection with the operation of their Internet businesses including, without limitation, the rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Submission; and to publish your name in connection with your Submission.

No compensation will be paid with respect to the use of your Submission, as provided herein. QOR is under no obligation to post or use any Submission you may provide and may remove any Submission at any time in QOR’s sole discretion. By posting, uploading, inputting, providing or submitting your Submission you warrant and represent that you own or otherwise control all of the rights to your Submission as described in this section including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submissions.


Liability disclaimer

The information, software, products, and services included in or available through the QORSurveys web site may include inaccuracies or typographical errors. Changes are periodically added to the information herein. QOR and/or its suppliers may make improvements and/or changes in the SayMore web site at any time. Advice received via the QORSurveys web site should not be relied upon for personal, medical, legal or financial decisions and you should consult an appropriate professional for specific advice tailored to your situation.

QOR and/or its suppliers make no representations about the suitability, reliability, availability, timeliness, and accuracy of the information, software, products, services and related graphics contained on the QORSurveys web site for any purpose. To the maximum extent permitted by applicable law, all such information, software, products, services and related graphics are provided "as is" without warranty or condition of any kind. QOR and/or its suppliers hereby disclaim all warranties and conditions with regard to this information, software, products, services and related graphics, including all implied warranties or conditions of merchantability, fitness for a particular purpose, title and non-infringement.

To the maximum extent permitted by applicable law, in no event shall QOR and/or its suppliers be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the QORSurveys web site, with the delay or inability to use the QORSurveys web site or related services, the provision of or failure to provide services, or for any information, software, products, services and related graphics obtained through the QORSurveys web site, or otherwise arising out of the use of the QORSurveys web site, whether based on contract, tort, negligence, strict liability or otherwise, even if QORSurveys or any of its suppliers has been advised of the possibility of damages.

Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.


Termination/access restriction

QOR reserves the right, in its sole discretion, to terminate your access to the QORSurveys Site and the related services or any portion thereof at any time, without notice.


General

To the maximum extent permitted by law, this agreement is governed by the laws of the State of New South Wales and you hereby consent to the exclusive jurisdiction and venue of courts in New South Wales in all disputes arising out of or relating to the use of the QORSurveys Site.

Use of the QORSurveys Site is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and QOR as a result of this agreement or use of the QORSurveys Site. QOR's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of QORSurvey's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the QORSurveys Site or information provided to or gathered by QORSurveys with respect to such use.

If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and QORSurveyswith respect to the QORSurveysSite and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and QORSurveyswith respect to the QORSurveysSite. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be drawn up in English.


Trademarks

The names of actual companies and products mentioned herein may be the trademarks of their respective owners. The example companies, organizations, products, people and events depicted herein are fictitious. No association with any real company, organization, product, person, or event is intended or should be inferred. Any rights not expressly granted herein are reserved.
